Welcome to the Office of Export Controls (OEC) Website!

Office Overview

This office was created in response to a recognized need on Grounds for a central office that could develop systems and best practices for compliance with a federal export control regulations.

 

Export Control Regulations

The OEC is responsible for assuring U.Va. compliance with the export regulations under the jurisdiction of the following agencies:

  • Department of State, Directorate of Defense Trade Controls
    • International Traffic in Arms Regulations (ITAR)
  • Department of Commerce, Bureau of Industry & Security
    • Export Administration Regulations (EAR)
  • Department of the Treasury, Office of Foreign Assets Control
    • International Trade Regulations (ITR)

However, many other Federal agencies also have export control administration and enforcement authority; click HERE for a list of some of the agencies that may regulate the export of research supplies, samples, technology and equipment. Although compliance oversight for these regulations is not the responsibility of OEC; we will provide informal guidance regarding the requirements of these regulations and put you in touch with the U.Va. or government agency that can provide additional assistance.

 

Export Control Reform Initiative

The Federal government is currently in the process of implementing changes to the US export control system. This reform initiative began with President Obama's call for a broad-based interagency review of the U.S. export control system in August 2009. The final intent of the reform effort is to create a unified approach that is transparent for exporters and governemnt agencies; the following are the principle goals of the initiative:

  • a single export control list;
  • a single licensing entity;
  • a single IT system; and
  • a coordinated enforcement approach led by a single agency.

OEC Support Activities

The UVA OEC strives to support university activities subject to export controls by providing accurate information, and improving or developing internal processes and procedures to prevent unauthorized exports. The following is a partial list of support services that are available from OEC:

  • Perform assessments to determine whether or not technology, software, data, or activities are subject to export controls.
  • Assist with proposal development to "carve out" fundamental research components.
  • Provide international travel advisories.
  • Appply for licenses or other permissions to support UVA activities subject to export controls.
  • Screen potential sponsors, collaborators, subscontractors, etc. to identify restricted parties (individuals, companies or other organizations) that have been denied US export priviliges or are otherwise prohibited from receiving US funds.
  • Provide up-to-date information on export control regulations and UVA processes for identifying and managing export controlled materials and/or activities.
  • Advise UVA faculty, staff and students on export control requirements.
  • Develop Technology Control Plans (TCPs) to prevent the unauthorized export of controlled technology, software and technical data.

OEC works closely with UVA contract negotiators to try and ensure that export controls are not inappropriately applied to UVa activities.

 

Import Reminder

Keep in mind that every U.Va. export is also an import; individuals new to exporting often overlook the fact that they must also comply with the import requirements of the receiving party's state/country or risk seizure or destruction of the shipment and potential charges or fines for illegal import activities.

Although not directly responsible for managing the U.Va. imports, OEC is happy to provide guidance on US import laws. However, our assistance may take the form of putting you in touch with the responsible U.Va. office or government regulatory agency responsible for oversight and enforcement.
